There is a primary duty of care for what they’re calling a PCBU. That is a person conducting a business or undertaking. It is its own entity, it’s an organisation, I call it, because it can be a ‘not for profit’, it can be a council, it can be a government department, or it could be a commercial operation.
What is a PCBU under the new Health and Safety Reform Bill?
There is a primary duty of care for what they’re calling a PCBU. That is a person conducting a business or undertaking.
It is its own entity, it’s an organisation, I call it, because it can be a ‘not for profit’, it can be a council, it can be a government department, or it could be a commercial operation.
So the PCBU is who will get the 3 million dollar fine for being reckless. They will get a 1.5 million dollar fine for being negligent, and they’ll get a half million dollar fine for just being non-compliant.
